Agreement to Terms
By accessing or using the Upstream Vacations websites and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our websites or services.
Booking and Reservations
When you book a property through our direct booking websites, you enter into a rental agreement for the specified property and dates. All bookings are subject to availability and confirmation. Rates, fees, and taxes are displayed at the time of booking and may vary by property, season, and length of stay.
You must be at least 21 years of age to make a reservation. The person making the reservation must be present during the stay.
Payments and Cancellations
Payment terms, including deposit requirements and cancellation policies, are outlined during the booking process and may vary by property. Refunds for cancellations are processed according to the cancellation policy in effect at the time of your booking. We encourage you to review the specific cancellation policy for your reservation before completing your booking.
Property Rules and Guest Conduct
Each property has specific house rules that are communicated before and during your stay. Guests are expected to:
- Treat the property and its contents with care and respect
- Comply with all posted house rules, including quiet hours and occupancy limits
- Not exceed the maximum guest count listed for the property
- Not host events or parties unless explicitly authorized in writing
- Leave the property in a reasonable condition at checkout
Violations of property rules may result in additional charges, early termination of your stay, or forfeiture of your security deposit.
Damages and Security Deposits
Some properties require a security deposit or damage protection fee. Guests are responsible for any damage to the property, its furnishings, or amenities beyond normal wear and tear. We reserve the right to charge the payment method on file for damages that exceed any collected deposit.
Assumption of Risk
Vacation rental properties may include amenities such as hot tubs, fire pits, waterfront access, docks, kayaks, and other recreational features. Use of these amenities is at your own risk. Upstream Vacations is not liable for injuries, accidents, or incidents that occur during your stay. Parents and guardians are responsible for supervising children at all times.
Accuracy of Information
We make every effort to ensure that property descriptions, photos, and amenity lists on our websites are accurate and up to date. However, we do not guarantee that every detail will be identical to what is shown. Minor variations in furnishings, decor, or landscaping may occur. If a significant discrepancy is identified, please contact us immediately so we can address it.
Intellectual Property
All content on our websites, including text, images, graphics, logos, and design elements, is the property of Upstream Vacations and is protected by copyright law. You may not reproduce, distribute, or use any content from our websites without written permission.
Third-Party Platforms
If you book one of our properties through a third-party platform (such as Airbnb or VRBO), the terms and policies of that platform also apply to your reservation. In the event of a conflict between platform terms and these terms, the platform terms will govern for bookings made through that platform.
Limitation of Liability
Upstream Vacations provides vacation rental management services and acts as an intermediary between property owners and guests. To the fullest extent permitted by law, Upstream Vacations shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or your stay at any property.
Modifications to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
Governing Law
These terms are governed by the laws of the State of Michigan. Any disputes arising from these terms or your use of our services shall be resolved in the courts of the State of Michigan.
